CDE Child Care Termination
California Department of Education (CDE) Programs - CalWORKs Stage 2 (C2AP), CalWORKs Stage 3 (C3AP), Alternative Payment, and Family Child Care Home Education Network (FCCHEN)
If you do not follow the specified guidelines, rules and regulations set forth by Child Care Resource Center (CCRC) of by the California Department of Education (CDE), CCRC may terminate your child care services or take other actions. If CCRC terminates you from subsidized child care for failure to comply with CDE / CCRC regulations or you disagree with any action taken by CCRC staff, you have the right to file a local appeal.
Appeal Procedure for CDE Programs
- Complete the back of the Notice of Action (NOA) that ended or changed your service and submit it to your Family Support Services Case Specialist before the NOA appeal date.
- Once your appeal request is received, your child care services will continue as originally scheduled while you go through the appeal process.
- CCRC will contact you to schedule an appeal hearing. You have the right to reschedule one appeal appointment.
- If you do not attend the appeal appointment, CCRC will consider your appeal abandoned and your child care services will end.
Appeal Hearing
- You must bring evidence that supports your claim that child care was inappropriately terminated or incorrectly changed.
- Within ten (10) days of your appeal hearing, you will receive a CCRC decision letter that either denies your appeal (upholds CCRC's decision) or grants your appeal (rules in your favor).
- If you disagree with the decision, you may appeal to CDE by following the instructions on the back of your NOA.
- You must submit your appeal to CDE within 14 days of the day you receive the decision letter.
- If your appeal is denied, you may be eligible for re-enrollment.
